Rental Conditions
RENTAL TERMS AND CONDITIONS 
The following rental terms and conditions form the basis of the contract between you (guest, client) and The Hideaway Madeira (owner, landlord) and Stay Madeira Island (agent, management company). Please read the rental terms and conditions carefully.Nothing in these booking conditions affects your normal legal rights.All reservations and bookings are subject to your agreement to these terms and conditions."We", "us" and "our" refer to The Hideaway Madeira and the registered owners of the domain hideaway-madeira.pt.References to "property", "holiday accommodation" and "accommodation" are to The Hideaway Madeira, Caminho da Levadinha nº2, 9370-634 Prazeres, Portugal, rented by the client.References to "guest", "guests", "client", "you" and "your" refer to the person making the booking and all members of the tour group.
TERMS OF PAYMENT
In order for a booking to be considered confirmed, we normally ask for a deposit of 50% of the total price. If the deposit is not received within seven days of the date of the booking request, the landlord has the right to cancel the booking. The remaining amount must be paid in full to the landlord 30 days before check-in. This is usually done automatically via our website.Please note that the percentage of the advance payment may vary. The owners reserve the right to change, adjust or cancel these rules without prior notice. PASSPORTS, VISAS AND HEALTH DOCUMENTS
It is your responsibility to ensure that you are in possession of all necessary travel and health documents, including passport and visa if applicable, prior to travel.DAMAGE DEPOSITThe landlords strive to maintain a trusting relationship with their guests and therefore do not charge a damage deposit.Should any damage be caused by the guest during the stay, exceeding the value of 10 Euros, it must be reported immediately to the management company.The owners reserve the right that the damaged item must be repaired or replaced by the guest or appropriate compensation paid by the guest before check-out.
CANCELLATIONS AND BOOKING CHANGES
100% of the deposit paid to confirm a reservation will be refunded if cancellation is made 90 days or more prior to arrival. 75% of the deposit paid will be refunded if cancellation is made 60 days or less prior to arrival. 50% of the deposit paid will be refunded if cancellation is made up to 30 days prior to arrival or earlier. After that 0% refund for cancellation.
No refund will be given for early departures.If something unforeseen comes up, a booking can be changed. To do so, please send an email to: info@hideaway-madeira.pt.Changes to the booking are subject to availability of accommodation and will incur a charge to cover the administration costs incurred, which will be notified to you at the time of the change request.In the highly unlikely event that The Hideaway Madeira is not available, we will be responsible for re-accommodating you in alternative accommodation of the same or higher category. If such an alternative is not found, you will be entitled to a full refund of all payments received for the booking.
SECURITY
For the safety of our guests, we use a security camera to guard the entrance area of the Hideaway Madeira Boutique Resort. Neither the garden nor the interior rooms are recorded.
TOUR GROUP MEMBERS AND CHILDREN
The tour group leader (person who made the booking) is responsible for all members of the group staying in the holiday accommodation.Adults are responsible for supervising children and minors at all times in accordance with their legal obligations.
LIABILITY
The Agent and the Owners shall not be liable in any way for loss of or damage to any goods or personal effects of the Guests and shall not accept any liability in the event of cancellation or withdrawal caused by war, civil commotion, strikes, illness, quarantine, adverse weather conditions, natural disasters, technical problems of any kind, terrorist activity, closure of airports or other circumstances beyond their control.
The Owners and the Management Company shall not be liable for any injury, illness, loss, damage or additional cost or inconvenience arising directly or indirectly from the design, structure, use or condition of the Accommodation and its premises, the accesses or contents thereof or the associated mechanical and/or electrical services or any defect therein.
The agent and the owners cannot be held liable for the actions of persons or for the failure of public services or supplies of a technical nature in connection with the holiday accommodation over which they have no direct control. Liability is limited to the provision of the booked accommodation.
THE ACCOMMODATION
The accommodation is reserved exclusively for the number of persons stated on the booking confirmation. No other persons may use the accommodation unless this has been agreed with us in writing and the relevant payments have been made. It is also not permitted to use the property for any purpose other than as a holiday home for the guests of the group. It is prohibited to hold parties, events or large gatherings of any kind on the property.
Subletting, sharing or assigning is prohibited. You agree to keep and leave the property, furniture and fixtures clean and in good condition. You further agree to take all necessary steps to protect your personal property.
MAINTENANCE
The property requires regular maintenance. You agree to allow us or one of our representatives access at reasonable times during your stay to carry out necessary repairs and garden maintenance. You will be advised of the day and approximate time for garden maintenance on arrival. The day and approximate time for carrying out necessary repairs will be notified to you if required.
The owners and their representatives must be allowed access to the property at all reasonable times on 24 hours notice.
COMPLAINTS
Should you wish to make a complaint, please inform the Management Company immediately who will do their best to resolve any problem promptly.
TRAVEL ARRANGEMENTS
Once you have made all your travel arrangements, please inform the landlord or management company of your flight number, arrival time at Funchal airport and the origin of the flight so that the accommodation can be prepared for you and you can be met on arrival at the accommodation.
If you do not provide this information, you may not be able to be checked in immediately upon arrival at the accommodation. If you have a flight delay or a delay on the way from the airport to the accommodation, please inform the management company of the new arrival time at the accommodation or arrange an alternative location for the handover of the keys. If you do not arrive by noon on the day following the arrival date and do not inform us of your expected late arrival, we may consider the booking cancelled.
ARRIVAL AND DEPARTURE
Check-in is from 4 pm and check-out is by 10 am. Occasionally a late check-out is possible - please check with the management company.
PETS
Unless otherwise agreed, pets are not permitted in the accommodation.
SMOKING
Smoking is permitted in all outdoor areas. It is forbidden to smoke indoors. We ask you to respect this rule.
WASTE DISPOSAL
When you arrive at your holiday accommodation, you will receive information about waste disposal and recycling in the nearest public waste containers.
HOUSEKEEPING
The final cleaning takes place after departure and includes the cleaning of all interior and exterior areas of the accommodation as well as the disinfection of surfaces. The change of bed linen and towels is also part of the final cleaning. We ask our guests to wash used dishes before departure. For the final cleaning we allow ourselves to charge a fee of 85 euros.
Furthermore, an option for intermediate cleaning is offered. The intermediate cleaning includes the cleaning of all indoor and outdoor areas of the accommodation as well as change of bed linen and towels. An additional fee will be charged for this service.
Bed linen and towels can also be washed in the washing machine provided and dried in the dryer provided. Detergent is not provided.
We would like to point out that we strive to save resources in order to preserve our planet. Therefore, we provide a clothes horse for drying the laundry.
SPECIAL WISHES
If you have any special requests, please let us know in your booking. Although we make every effort to accommodate all reasonable requests, unfortunately we cannot guarantee that all requests can be fulfilled. Failure to fulfil special requests does not constitute a breach of contract on our part, nor are we liable to pay any compensation.
IN CASE OF DISPUTE
In the event of any dispute, Portuguese law shall apply and the Portuguese courts in Funchal, Madeira shall have exclusive jurisdiction.
